Senate Bill Brings Back Reimbursements and Offsets in Divorce
In September, 2009, Texas lawmakers amended the state’s statutes on economic contribution rules. Economic contribution claims are brought in divorce cases where one spouse asks the other spouse to repay contributions made to benefit either 1) that spouse’s separate property, or 2) the marital community’s property.
As it stood, the old law relied upon a confusing statutory formula and definition. The new law simplifies the doctrine, and returns to a more traditional methodology for evaluating economic contribution claims.
