Divorce Requirements in Lake Travis

All states have residency requirements for filing a divorce within their borders. Texas mandates a divorce petitioner or their spouse live in the state for at least six months before a divorce filing. The resident spouse must live in the county the divorce is filed for a minimum of ninety days.

There are exceptions for active duty military and government employees working out-of-state. However, unless domestic violence is an issue, the court will not grant a divorce for a minimum of sixty days once filed.

Grounds for Divorce in Lake Travis

Texas offers both no-fault and fault grounds for divorce. In a no-fault divorce, neither party must accept blame for the breakup of the marriage. The no-fault grounds for divorce in Texas are the insupportability of the marriage and separation of more than three years without marital relations. Insupportability amounts to irreconcilable differences between spouses.

If a spouse chooses to divorce for fault, they are responsible for proving their case. This can be a lengthy and expensive process. Therefore, no-fault divorces, typically based on insupportability, are the most common type of divorce in Texas.

Fault grounds for a Texas divorce include:

  • Cruelty;
  • Adultery;
  • Felony Conviction;
  • Abandonment; and
  • Confinement to a mental hospital.

A fault-based divorce can impact property division. However, it may not be the best choice based on individual circumstances.
